What is the maximum security deposit?

For unfurnished rental, the security deposit cannot exceed 1 month's rent excluding charges. This cap is set by Article 22 of the Law of July 6, 1989 as amended by the ALUR law. The landlord cannot under any circumstances require a higher amount. If the lease provides for a higher amount, the clause is deemed unwritten.

What is the return deadline?

The security deposit must be returned within 1 month after key handover if the exit inspection matches the entry inspection. If differences are found, the deadline extends to 2 months. After this deadline, the remaining amount accrues late interest at 10% of monthly rent for each month of delay.

What deductions can the landlord make?

The landlord can deduct for: unpaid rent or charges, tenant repairs (excluding normal wear), damage noted on the exit inspection. Each deduction must be justified by invoices or quotes. The landlord cannot deduct for normal wear (faded paint after several years, for example). In condominiums, they may retain up to 20% pending the annual account statement.
