What constitutes door-to-door sales?

Door-to-door sales (or off-premises sales) refer to any sale or service provision made outside the professional's usual place of business: at your home, workplace, in public transport, in a public place, or during an excursion organized by the professional. Since the Hamon law of 2014, the door-to-door regime also includes contracts concluded following telephone solicitation by the professional. The seller must provide a written contract with a detachable withdrawal form.

Can the professional start work during the withdrawal period?

In principle, the professional cannot begin contract execution during the 14-day withdrawal period. However, the consumer may expressly request in writing that execution begins before the end of the period. In that case, if they subsequently withdraw, they will have to pay for services already provided on a pro-rata basis. For energy supply contracts, the prohibition is absolute during the first 7 days. The professional cannot require any payment during the withdrawal period, except at the consumer's express request.

What if the seller doesn't respect withdrawal rights?

If the seller refuses to honor your withdrawal right or did not inform you of this right, the withdrawal period is automatically extended by 12 months (totaling 12 months and 14 days). You can contact the DGCCRF (General Directorate for Competition, Consumer Affairs and Fraud Control) or the consumer mediator. The professional faces criminal penalties of up to €15,000 for individuals and €75,000 for legal entities. You can also take legal action.
